BATH HALF MARATHON  CHARITY TERMS & CONDITIONS (“Terms”)

Parties :

Time Is Precious charity number 1141671 and whose registered office is at 25 Preachers Vale, Coleford, Radstock, Somerset, BA3 5PT,

  1. Introduction
  2. These terms and conditions (the “Terms”) shall apply to the  Bath Half Marathon (the “Half Marathon”) and the Family Fun Run (the “Fun Run”) organised by Running High Events Limited (together, the “Race”) and charity Time Is Precious.
  3. The Race is organised and administered by Running High Events Limited (“Running High” which expression includes their employees, event officials, authorised agents, sub-contractors or volunteers). Time Is Precious will not have any paid workers on the day on the event, everyone will be there on a totally voluntary basis.

iii. These Terms regulate the relationship between Time Is Precious and their runners for Bath Half Marathon event.

 

  1. Application Process
  2. We would be delighted for you to be part of Team TIP. We have limited places available.
  3. Once you have requested to join Team TIP, we can reserve your place for up to 10 days (or if otherwise agreed).

iii. We then ask that you pay the entrance fee within the period agreed, otherwise we are unable to guarantee you a place with us.

  1. After being registered through Running High’s registration system charity runners will be treated in the same way as general public entrants, receiving confirmation of their place after processing, receiving regular email newsletters, being eligible for club team events, prize money, and their race packs being posted direct to them by Running High before the race in accordance with Data Protection Legislation.
  2. Time Is Precious, will update you via regular emails about the day & the weeks leading up to it.

 

  1. What Team TIP Provide
  2. Being part of Team TIP, gives you an amazing feeling of achievement, whilst being supported however much you feel you need.
  3. An extremely friendly team, that can offer FREE tips when needed.

iii. FREE Running HUB. Please join our Facebook Page TIP Running HUB. We have training sessions that you can join & training runs throughout the year. It is a place that people can ask questions, see if anyone would like to go out for a run together etc. As time progresses closer to the date, we even provide refreshments where possible after the runs.

  1. A great place to meet new people, have fun & support.

 

 

 

  1. Sponsorship Scheme

We understand how difficult getting sponsorship can be sometimes, especially if you have completed this or something similar before. So since 2021, we will have our “sponsorship scheme”. When you can do:

(a) 1-2 events for children to participate in, probably a walk, run or cycle, as children seem to get sponsorship easier than adults!!

(b) We suggest if you attend a coach led run or training session, to donate £1- £2 to go towards your sponsorship.

(c) We will try to organise a different event that you can participate in free of charge.

 

  1. Official Rights

i Running High shall organise and stage the Race in accordance with clause 20.

  1. Time Is Precious, purchase a quantity of places via Running High. These places are at a lower cost than the public entries, however, we do lower the rate even further, as an incentive to join us.

iii. Running High, provide and maintain a designated on-line registration system (“the Portal”) to allow Race Charities to register for their allocated Race Entries on our entrants behalf.

  1. Running High shall be responsible for ensuring the security of the Portal and shall ensure all personal and other information contained on the Portal is appropriately protected from cyber threats in accordance with the requirements of the Data Protection Legislation.
  2. Running High & TIP, adhere to GDPR.
  3. TIP will be taking photographs & sharing on social media, sometimes media & on our website. Running High “may” also do the same.

 

  1. Payment Process
  2. Time Is Precious, will allow 10 days (unless otherwise agreed) for the entrant to pay for their place. During this time places will be secure.
  3. After this time if the entrant has not contacted TIP, we will make contact again & the place can not be guaranteed.

iii. Once payment has been paid, TIP will contact you to confirm your place. Payment can be sent either via BACS, cash or cheque. (Address & bank details will be given upon request of the place.

iii. Unfortunately, we are unable to give refunds, if you are unable to run. However, if significant time is given, we can roll the place over to the following year, at a very small admin charge.

 

  1. Sponsorship Pledge & Initial Donation
  2. We know how difficult it can be to get sponsorship. This is why we ask for a minimal amount, compared to other charities.
  3. We ask that you raise at least the minimal amount, this also covers our cost for running tops, refreshments, the marquee and all we provide. Therefore, the more you raise, the more you can help sick & disabled children at home & in hospital.

iii. Some charities ask for a pre-payment of sponsorship, as you will be surprised the amount of people that have the free training, running top, refreshments etc & donate nothing or very little, which leaves us in a minus situation, which in return takes away supporting sick & disabled children. We do not ask for this at present, as we like to trust our runners, so please do not put us in the predicament of having to do this.

  1. We ask that every person sets up a Justgiving page. This is the easiest way to gain sponsorship & the funds go automatically into TIP bank account, so hassle free. We also send out sponsorship forms & welcome packs in approx November, please keep these safe.

 

 

  1. Substitution/ Transfer of Cancelled Charity Entrants
  2. Time Is Precious, has the right to cancel places if a runner does not comply to the terms & conditions. (This has never been done before).
  3. Cancellation of places can be rolled over to the following year “if” enough notice is given for a small admin fee.
  4. Cancelled runners may still receive their race packs if notification of cancellation is received after a runner’s details have been sent to Running High’s mailing house for processing. Cancelled runners will be asked to return their race number to Running High, and their race number will be voided.

iii. Registered race entries are personal to the entrant and cannot be transferred between runners, if this does happen, we will have to cancel the place & it becomes void. If caught, you maybe penalised by Running High.

 

  1. Facilities on Race Day
  2. The Facilities listed below are offered subject to government and local authority restrictions to restrict the spread of infectious disease, including coronavirus (“COVID Restrictions”).
  3. Time Is Precious, purchase a large marquee for the day (subject to COVID Restrictions) , for the comfort of our runners. We have to prioritise our runners, so any family & friends that come along on the day, “maybe” asked to leave if it becomes at full capacity (although we try to accommodate).

iii. TIP provide a large array of impressive refreshments in our hospitality marquee. Please let us know if you have any special dietary requirements or allergies. These are free of charge.

  1. Massager will be available pre & after the event for Team TIP only. We do ask for a small donation if possible, as a thanks to our therapists.
  2. We have second to known cheering & support on the day (you will hear us)!! With TIP PIT stops on route.
  3. Toilets will be available on the day in the Running village & on the course.

vii. TIP, reassure our runners we do everything possible to prevent any circumstances arising, we have a first aid kit, foil blankets, hand sanitiser, and plenty of volunteers to ensure your experience with Team TIP is second to none.

viii. TIP, provide free running tops. All Team TIP runners must wear these on the day.

 

  1. Sponsorship returns
  2. We ask that all sponsorship is sent to us no later than 3 months later (as soon as possible is idea), as it takes us almost a full year to arrange this event.
  3. Failure to donate sponsorship may result in being black listed & reported to Running High. Therefore, other charities could be notified & maybe blacklisted from participating again.

 

 

  1. Event Management
  2. Running High shall : (a) organise and stage the Race at their sole cost and expense in accordance with the terms of the Contract with a reasonable standard of skill and care; (b) arrange the attendance and payment of sufficient stewards, staff and personnel necessary to safely manage the event; (c) take out and maintain a comprehensive insurance policy for the Race, including; i. adequate public liability insurance for injury or death of any participants, or spectators due to the actions of Running High’s staff and personnel at a minimum level of cover of £5 million pounds; and ii. adequate cancellation insurance for a Force Majeure event beyond Running High’s reasonable control (d) use reasonable endeavours to procure that contractors, suppliers, sponsors, Race Charities and/or their agents engaged by Running High also take out adequate public liability insurance in respect of their actions; and (e) comply with all applicable laws (including the Modern Slavery Act 2015 and the Bribery Act 2010) and comply with any conditions attached to any licences or consents issued in connection with the event, including regarding health and safety and crowd safety.
  3. In the event of a dispute or claim brought by a data subject or any Regulator concerning the processing of the Personal Data against either or both of the Parties, the Parties will inform each other about any such disputes or claims promptly, and will cooperate with a view to settling them amicably in a timely fashion.
  4. Running High is acknowledged to be a Data Controller in respect of participant data appearing on the Portal once a race entrant has registered their details on the Portal v. TIP is acknowledged to be a Data Controller in respect of participant data downloaded or obtained by the Race Charity from the Portal.
  5. Running High shall be responsible for ensuring the security of the Portal and shall ensure all personal and other information contained on the Portal is appropriately protected from cyber threats in accordance with the requirements of the Data Protection Legislation.

vii. TIP shall be responsible for ensuring the security of participant data downloaded or obtained by the Race Charity from the Portal and shall ensure all such personal and other information is appropriately protected from cyber threats in accordance with the requirements of the Data Protection Legislation.

 

  1. Race Rules
  2. Each Race entrant (including charity entrants) is required to complete the standard declaration at point of entry and to comply with the requirements of the Race Terms and Conditions of Entry.
  3. Running High reserves its right to refuse to accept applications from Race entrants, to cancel applications and to disqualify individual runners breaching the Race Rules, or upon advice from the medical team without liability to the Race Charity.

 

 

  1. Limitation of Liability
  2. Force Majeure; Neither parties shall be in breach of the Contract nor liable for delay in performing, or failure to perform, any of its obligations under the Contract if such delay or failure results from events, circumstances or causes beyond its reasonable control. For the avoidance of doubt, a Force Majeure event shall include but shall not be limited to: (a) acts of God, flood, drought, earthquake or other natural disaster; (b) exceptionally adverse weather conditions: (c) epidemic or pandemic; (d) terrorist attack, civil war, civil commotion, or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (e) nuclear, chemical or biological contamination or sonic boom; (f) any law or any action taken by a government or public authority, including without limitation imposing an export or import restriction, quota or prohibition, or failing to grant a necessary licence or consent or refusal by the local council to grant road closures; (g) refusal by the Bath Recreation Ground Trust to grant a licence in respect of the hire of the venue for the event. v. In such circumstances, Running High reserves its right to take any such action as it sees fit, including but not limited to, changing the date of an event or changing the event venue, course route or distance (provided that it does not substantially change the event and provided that the event still takes place.).
  3. Time is Precious shall not be liable for any loss or injury arising from the event or leading up to in the participation in the Bath Half save to the extent caused by Running High’s negligence.

iii. In the event of a Force Majeure Event; Time Is Precious, (a) Will not be able to refund any entry fee, but will roll the place over to the following year (a small fee “may” occur).  (b) Where possible, will arrange an alternate route when safe to do so, at no extra cost, so that sponsorship will be obtained.
